The general terms and conditions set forth below shall apply to all sales of products by SUNTIME EVENTS SRL,through the online store. www.purpleflowers.roto the buyer and may be modified at any time by SUNTIME EVENTS SRL without prior notice.

Buyer / Customer – natural person/legal entity or other legal entity issuing an order. Seller / Company – SUNTIME EVENTS SRL

User / Visitor – any natural/legal person visiting the website www.purpleflowers.ro.

Products – any product displayed on the website and mentioned in the order, to be supplied by the seller to the buyer.

 

Order – an electronic document that intervenes as a form of communication between the seller and the buyer, by which the buyer expresses his intention to purchase certain goods and to make payment for them.

 

Order processing – all the actions performed in relation to an order, from the moment the order is received to themoment the invoice for this order is sent. These actions refer to (but are not limited to): checking payment, sending the order to work, making the product, delivering the order, confirming delivery, issuing and sending the invoice.

2  INTELLECTUAL PROPERTY LAW

 

Entire website content www.purpleflowers.ro: images, texts, products, information, graphics, web graphics, logo (butnot limited to these) is the entire property of SC SUNTIME EVENTS SRL and its collaborators and is protected by the Law on copyright and related rights and by the laws on intellectual and industrial property. Taking them without the written consent of SUNTIME EVENTS SRL is illegal and punishable by law.

 

The taking of images is allowed only if you want to place an order to SUNTIME EVENTS SRL.

 

3  DISCLAIMER

 

SUNTIME EVENTS SRL does not guarantee that the website, the servers on which it is hosted or the e-mails sent fromwww.purpleflowers.ro are free of viruses or other potentially harmful computer components, that they do not contain errors, omissions, defects, delays or interruptions in operation or transmission, line failures or any other similar factors.

 

 

The user uses the site at his/her own risk, SUNTIME EVENTS SRL being free from any liability for any direct or indirect damage caused by using or accessing/visiting the site.

 

4  LEGAL AGE

 

The minimum legal age for placing an order on www.purpleflowers.ro is 18 years. In order to be able to order alcoholicproducts (bottle of wine from the category GIFT GOODS or option ADAUGA GIFT) through our website, customers declare that they are 18 years old by the date of placing the order and also that the recipient of the gift is 18 years old by the date of delivery.

 

5  SECURITY

 

The security of your card data is very important to us. The website www.purpleflowers.ro processes card data enteredthrough our partner EuPlatesc.ro (EuroPayment Services SRL).

 

The card data entered when paying for an order is not stored on the site and cannot be accessed by our employees. Forthe security of your data, data entry is performed directly on EuPlatesc.ro (EuroPayment Services SRL) secure servers. The transmission of card data is only encrypted, in accordance with the laws in force, and only in compliance with the rules required for the security of payment processing solutions.

 

For transaction security reasons the buyer is advised not to stay logged in on the site and not to set the automatic loginoption on mobile devices. Disclosure of the account password is not allowed and it is recommended to use a strong security password (containing at least eight characters, including uppercase letters, lowercase letters, digits and special characters).

 

6  USER REGISTRATION

 

The www.purpleflowers.ro website can be accessed and visited without the need to log in or register as a user (create an account). User authentication or registration is also not required when placing an order.

 

User registration is recommended for keeping order history, saving favorite addresses, and billing data.

 

Registration as a user can be done with your email address (requires confirmation from email) or Facebook account. Registration as a user implies acceptance of these Terms and Conditions. The www.purpleflowers.ro website does not record/hold/use in any way the information related to the access data of the email or Facebook account. www.purpleflowers.ro does not interact on its own or on behalf of users/visitors/customers with their Facebook or Google Plus account.

7  ORDERS

 

Flower bouquets, floral arrangements and other products presented on the website can be purchased both online,directly on the website, and by phone at 0755 138 138 or by email at comenzi@purpleflowers.ro.

 

7.1  ONLINE ORDERING

 

The online shop www.purpleflowers.ro gives you the possibility to order directly on the website any productdisplayed in the categories listed in the menu bar or in other places where they are displayed on the website.

 

To place an order online you need to:

 

• choose the product you want;

 

• read the specifications, product description, price and availability;

 

• if it’s the right product for you, select the delivery date, preferred delivery time, add a message and extras if you wish, then add the product to your cart;

 

• at this point you can continue to checkout as an unregistered user or create an account later:

 

• you fill in the billing details;

 

• fill in the delivery dates;

 

• fill in any other comments you have for us;

 

• select your payment method;

 

• read the list of Terms and Conditions and tick that you agree with the clauses mentioned

 

• press the finalize order button

 

After completion, you will receive an email with the status of the placed order (“Pending – in progress, Processing – being processed, Failed – payment has been failed, etc.) to your registered email address. If this email is not in the”Inbox” section, check the “Spam” section.

 

The customer has the obligation, after receiving the order confirmation by email, to carefully check all the information and to notify us immediately of any errors. SUNTIME EVENTS SRL is not responsible for any delay or miscommunication caused by customer errors, omissions, interruptions, deletion of files from the email, errors, defects, viruses, delays in operation or transmission, etc..

 

If you have selected the payment method: Online payment by card, you will also receive a payment confirmation email from our partner EuPlatesc.ro (EuroPayment Services SRL).

 

After delivery you will receive an email with the order status “Complete” (i.e. the order has been delivered) and an email with the invoice for the order. The time of sending the order status change email may be different from the actual time ofdelivery. We reserve the right to change the order status within 1 to 72 hours of delivery.

7.3  ORDER BY EMAIL

 

Our operators will immediately take your order sent by email to comenzi@purpleflowers.ro. The customer has the obligation to check carefully all the information after receiving the order confirmation by email and to notify our employees immediately of any errors.

By placing an order by email to one of the email addresses displayed on the site, you declare that you have read and agree to the terms of the Terms and Conditions.

7.4  ORDER CONFIRMATION

 

The Order Confirmation / Proforma Invoice together with the unique order number (Order ID) will be sent to customers only by email with each new order placed on www.purpleflowers.ro. It is the customer’s obligation to verifyany information provided in the order and to notify us if any errors have occurred in the information provided. Any complaint (in writing by email or by telephone) will be made mentioning the unique order number received. In this case, customers will receive the updated Order Confirmation by email.

 

8  PRODUCTS

 

The products available on the www.purpleflowers.ro website may contain dried or preserved materials, glass, wood, metal or plastic backing, floral sponge, soil, wire flowers, green plants, flowering plants, fruit plants, fruit, vegetables or other decorative elements. They are not intended for human consumption.

 

The gifts (food products) that can be added through the “GIFT GIFT” option to the products or food products in thegifts displayed in the “GIFT GOODS” menu are products intended for human consumption.

 

According to O.G. 21/1992, Law 449/2003 and O.G. 174/2008, O.G. 34/2014 the products sold onwww.purpleflowers.ro benefit from the guarantee, except for perishable products – flowers, plants.

 

The website www.purpleflowers.ro offers a 3-day guarantee for products containing flowers on the wire, to maintain the freshness of the flowers, but only if the maintenance rules mentioned on the product label are respected. SUNTIME EVENTS SRL will respond to any warranty request only if the returned product is intact and accompanied by proof of purchase. The return of the product is made at the seller’s premises or by courier, in which case the shipping costs willbe borne by the customer. The guarantee will be settled within 14 calendar days of receipt of the request. The guarantee is not granted for products that show signs of dents, cracks, scratches, or are returned incomplete or without proof of purchase.

 

On each product page you will find the photo, specifications and description of each product. Some products maybecome unavailable in stock at a certain time. SUNTIME EVENTS SRL has no obligation to notify customers of stock availability in real time. Certain products may undergo changes in pictures, specifications, price or stock at any time, without being obliged to notify customers or website visitors of these changes.

 

8.1  PRODUCTS WITH FLOWERS AND PLANTS (FLOWER BOUQUETS, FLOWER ARRANGEMENTS,PLANT ARRANGEMENTS, TERRARIUMS, POTTED PLANTS)

 

All photos shown on the website are for presentation purposes only, bouquets and arrangements may differ slightly fromthe photo depending on available stock and designer’s hand. Plants may differ slightly from the photo shown as well.

 

The products containing flowers are handmade, individually and slightly different from each other. Not only the designer’s hand can differ. Flowers and plants are natural and unique.

Even those of the same species differ slightly from each other. And plants grow differently, so they may differ slightly from the photo shown on the website.

 

Since the availability of certain flower and plant assortments differs according to the season, or in case a certainassortment is not in stock at a given time, we reserve the right to exchange that assortment for an equivalent assortment in style and of the same or higher value. If the change is major, we will try to contact you for agreement. Supporting plants (leaves, greenery) and vases may be exchanged without prior notice. If we are unable to contact you through thechannels used in the previous communication, we will consider that we have your consent.

 

In order to enjoy the flowers or plants you receive as much as possible, please consider some recommendations:

 

• Before putting the bouquet in the water, cut 1-2 cm of the flower stems and rinse the vase well. Replace the water, cut 1-2 cm from the stems of the flowers and rinse the vase thoroughly every In the case of flower arrangements made in floral sponge, add a little water every day to avoid drying out the floral sponge;
• Water plants and plant arrangements whenever Some plant arrangements and terrariums can be made in pots that do not allow excess water to drain away. 8.2  DECORATION PRODUCTS

All products are handmade, and eachproduct is unique, so delivery of products can take between 2 and 7 days.

 

In order to enjoy these products as much as possible, please consider some recommendations:

 

• This product is made only from dried or preserved materials in glass, wood, metal or plastic. Preserved moss (also called stabilised lichens) and preserved plants and flowers (also called stabilised or ‘cryogenised’) retain their appearance for several years in the following conditions:
• the products should be stored only indoors, in ventilated spaces, with normal humidity and a temperature between 15 and 30 degrees C;
• products MUST NEVER WATER;
• products should not be exposed to the sun (UV rays), or to direct heat/cold sources (radiators, air conditioners);
• touching or pricking should be avoided as much as possible;
• The product will only be dusted with a feather
• Both preserved moss and preserved plants and flowers NEED NO Contrary to all the informationcirculating on the internet (that canned moss grows very slowly, that it absorbs moisture from the air or that itneeds to be sprayed with water), canned moss, canned plants and canned flowers DO NOT grow and DO NOT need water. 8.3  GOURMET PRODUCTS

 

These products are intended for human consumption, but only on condition that they comply with the storageinstructions on the packaging of each product and within its shelf life. These products are purchased from specializedstores and are not produced by SUNTIME EVENTS SRL.

 

8.4  ADDITIONAL PRODUCTS

 

For certain products presented on www.purpleflowers.ro you have the possibility to add a vase or a gift.

 

The price of each additional product is displayed in the add-on option for that product. Adding a personalised message is a free service available to our customers.

 

If one or more of these options are not active on a product page, that product cannot have those additional products added to it.

 

8.5  CANCELLATION OF ORDER OR MODIFICATION OF PRODUCTS

 

You can change your mind about your order. Changes or cancellations will be made only in writing to the email address comenzi@purpleflowers.ro at least 24 hours before the delivery time.

 

We try to respond to last minute changes, but we can only guarantee changes submitted at least 24 hours prior to delivery time.

 

In case of cancellation of the order, respecting the mentioned term, SUNTIME EVENTS SRL guarantees 100% refund of the payment within 14 days from the notification.

 

In case of cancellation of the order after the mentioned term, SUNTIME EVENTS SRL will refund only 50% of the payment made within 14 days from the request.

 

8.6  RENTALS

 

All products presented in the RENTALS category are rented following a request for an offer. SUNTIME EVENTS SRL can set different prices for each product depending on the event/occasion, the quantity of rented products or the packageof rented products. Price offers are sent by email for each event/occasion.

 

The products can be rented following the conclusion of a RENTAL CONTRACT between SUNTIME EVENTS SRL and the client. The transmission of a request for an offer or a quotation for certain products does not bind the client orSUNTIME EVENTS SRL in any way if it is not followed by the conclusion of a RENTAL CONTRACT.

 

The price offers submitted are valid for 48 hours. Product prices may be changed after the 48 hours have expired even if the customer returns for the same event/occasion.

 

The submission of a quotation does not oblige SUNTIME EVENTS SRL to reserve the products in question. The reservation of the products can only be made following the conclusion of a RENTAL CONTRACT. The products may be available at the time of sending the quotation and may be unavailable afterwards if another customer concludes a RENTAL CONTRACT for them. SUNTIME EVENTS SRL is not obliged to notify a customer if another customerexpresses interest in the same products or if another customer concludes a RENTAL AGREEMENT for the same products and they become unavailable.

8.7  DISCOUNTS

Depending on the seasonality of the flowers, discounts will be applied to selected products on the www.purpleflowers.ro website.

Discounts may vary from one product to another and from one season to another and are valid within the limits of available stock.

The seasonal promotion period applies as follows:

– for spring products the promotional campaign on selected products runs from 01.02 to 31.05, annually.

– for summer products, the promotional campaign on selected products runs from 01.06 – 31.08, annually.

– for autumn products, the promotional campaign for selected products runs from 01.09 – 30.11, annually.

– for winter products, the promotional campaign for selected products runs from 01.12 – 31.01, annually.

For Christmas products, the promotional offer period runs from 01.11 – 31.12. Exceptionally, depending on available stock, we may apply an off-season discount campaign on selected products from 01.01-31.10, annually.

 

9  RETURN OF PRODUCTS

 

By law, perishable products cannot be returned – flowers and plants are perishable products.

 

Food and non-food products can be returned within 14 calendar days from the receipt of the order, only after the customer notifies in writing the return request to SUNTIME EVENTS SRL at the email address comenzi@purpleflowers.ro, and the request will be processed within 1-3 working days.

 

The conditions for return are the following:

 

• non-perishable products are returned intact, containing all original parts/items/accessories;

 

• the return is made by sending the products to the address Strada Tuzla, 44, Sector 2, Bucharest, by any express courier, except Posta Romana;

 

• the return parcel will be paid by the customer at the time of dispatch, otherwise it will be refused on receipt;

 

• The package will contain all the documents received

 

In case of compliance with all the conditions of refund, the amount paid will be refunded in full, within a maximum of 14 days from receipt of the request for return and acceptance of the return from SUNTIME EVENTS SRL. The customer will receive the amount paid, but will not be entitled to any other compensation.

 

10  DELIVERY

 

The delivery of the products is done by our employees or specialized courier to the address specified by the customer in the order form or the products can be picked up at Purple Flowers Workshop.

 

Because we want the flowers to reach you in the best conditions, we ensure delivery by our internal couriers in Bucharest and surrounding areas.

We

cannot always guarantee the desired delivery times, because unforeseen situations may occur that are out of our control (e.g. bad weather, heavy traffic, high volume of orders, etc.), but we do our best to meet them when possible.

 

If the recipient is not (no longer) at the location indicated in the order, we will contact the recipient to provide an alternative delivery address so that the order arrives on the date specified by you.

 

10.1  DELIVERY TIME AND SCHEDULE

 

Any order can be delivered in Bucharest and surrounding areas, within 2-6 hours from payment confirmation.

 

Delivery hours are 10:00 – 21:00 Monday to Friday and 10:00 – 19:00 Saturday and Sunday. The delivery schedule can be modified at certain times of the year.

Any order paid by 18:00 can be delivered the same day. Orders placed after 18:00 willbe delivered the next day.

Between 1-8 March, both in Bucharest and in the provinces, we cannot guarantee the delivery date regardless of when the order is placed. Although we can process a very large volume of orders, during this period, deliveries can be 1-2 days late.

 

The delivery of flowers in other counties of the country is done by courier companies and can be done in 1-2 working days.

 

Products with delivery in other counties may undergo changes so that the delivery is made in the best conditions. Flower boxes and flower arrangements in vases will be transformed into flower bouquets with the same floral and chromatic composition.

The terrariums and plant arrangements will be transformed into DIY kits, accompanied by instructions for assembly.

 

10.2  DELIVERY COSTS

 

The delivery of the ordered products is free for any order with delivery in Bucharest and the surrounding areas for orders over 100 lei, or 19 lei for orders under 100 lei.

 

However, in certain cases, when the distance to the customer’s delivery address exceeds 15km, SUNTIME EVENTSRL will decide to charge the delivery according to the number of additional km. The customer will be informed before the order is processed. The order will be processed after the customer accepts and pays the delivery cost. If the customer does not agree with the delivery cost, SUNTIME EVENTS SRL reserves the right to cancel the order.

 

10.3  SPECIAL DELIVERY CONDITIONS

 

SUNTIME EVENTS SRL is not responsible for unsuccessful / missed deliveries resulting from the absence of the recipient at the time of delivery, at the address provided by the sender. Due to the perishability of the products with flowers, we are not liable for the depreciation/loss of the products as a result of an extension of the delivery time due to an incorrect delivery address provided by the customer, a delay or a redirection requested by the customer or by the recipient, a delay or a redirection arising due to the absence of the recipient from the address.

 

If access to the addressee is restricted (doorman, checkpoint, addressee in hospital, etc.) and the courier is not allowed access to the addressee, or if the addressee is missing from the address, the parcel can be received by a third person (doorman, receptionist, neighbour, relative, colleague, etc.) if this person signs for the parcel. Under these conditions the order will be considered delivered.

 

If no other person who has access to the addressee wishes to sign for receipt or the addressee is not present at the address and cannot be reached by telephone, the courier will return to the address a maximum of two more times. If the addressee is not found after 3 attempts, SUNTIME EVENTS cannot be blamed for the failed delivery and the customer will be informed of this situation and will inform us how he/she wishes to proceed. The product may be destroyed, or delivered, on request, to a new address. SUNTIME EVENTS SRL is not responsible in case of product degradation due to its transport by courier for two days. The customer may request, against payment, the arrangement to be refreshed if necessary. The amount necessary to refresh the arrangement will be communicated to the client. If we are unable to contact the customer through the communication channels previously used, the product will remain in our workshop for 2 days. After this period, the product will be destroyed and the order will be considered completed.

 

If the recipient refuses to receive the parcel, SUNTIME EVENTS SRL cannot be blamed for the failed delivery and the customer will be informed about this situation and will have to inform us how he/she wishes to proceed. The product can be destroyed, or can be delivered, on request, to a new address. If we are unable to contact the customer through the communication channels previously used, the product will remain in our workshop for 2 days. After this period, the product will be destroyed and the order will be considered completed.

 

SUNTIME EVENTS SRL assumes no obligation if delivery cannot be made in case of extreme weather conditions (code yellow / code red / code orange) or in case of limited access to the address. Shipment of the order in questionmay be postponed or redirected to a new address with delivery within 24 hours.

 

As there are some very busy periods during the year (Christmas, Valentine’s Day, 1-8 March, Easter, other holidays)please schedule your orders in advance around these times of the year. SC SUNTIME EVENTS SRL reserves the right to postpone the delivery date for orders placed during these periods of the year.

 

A successful delivery depends to a large extent on the accuracy of the data provided (name and address of the recipient, telephone number, date and time of delivery, etc.).

 

An order in one of the above mentioned situations cannot be considered as undelivered / non- conforming delivery / damaged goods. We undertake to provide details of the status of a delivery to our customers as soon as possible whenrequested and to do everything possible to facilitate the delivery of orders.

 

Any redirection of a product to a new address following one of the above situations and requested by the customer, ismade only after payment of a shipping fee of 25 lei / delivery address, regardless of the order value.

 

If the order is delivered, under the signature of the mentioned recipient or another person at the address, at the time agreed by both parties, then the company is exonerated from any penalties, fines or returns for any situations arising subsequently.

 

10.4  ANONYMOUS DELIVERY

 

Orders placed on www.purpleflowers.ro with the promise of anonymity will not be disclosed to the recipient except in exceptional cases, at the request of the Authorities or with the consent of the customer.

 

The recipient of the parcel may be contacted by telephone prior to delivery to validate the address and time of delivery, but will not be told what they are to receive, using the general term “parcel”, and any information regarding the identityof the customer will not be passed on to the recipient.

 

10.5  DELIVERY CONFIRMATION

 

SUNTIME EVENTS SRL will send after delivery, in 1 to 72 hours, by email, the invoice. In certain busy periods, the transmission of the invoice may take several days.

 

11  PAYMENT

 

All prices displayed on www.purpleflowers.ro are final and include VAT. 19% for flower products, flower and plantarrangements, alcohol products, sugared food products and other non-food products or 9% for plants and sugar-free food products.

 

Because we want to make it as easy as possible for you, you can choose any of our payment methods for online orders on the website:

 

• Online payment by credit card, (Visa Classic/Electron, Mastercard, Maestro) safe and fast, when you complete your order you will be redirected to the secure server interface of our partner EuPlatesc.ro (EuroPayment Services SRL);
• Cash on delivery – for security reasons, if you opt for cash on delivery, orders over 800 lei cannot be placed.

Payment by bank transfer can be made at the bank’s head office or via internet banking. If you choose this option,please note that the processing of the order and its delivery will be done only after the confirmation of the payment by the bank.

 

For information, for interbank payments (from other banks) made before 12:00 during the day, the money is generally transferred the same day. For interbank payments made after 12 noon, the money will generally be transferred in the morning of the following day. For intrabank payments (from Banca Transilvania), the money is transferred almost instantly.

 

This schedule is strictly informative, SUNTIME EVENTS SRL is not responsible in any way for delays caused bysettlement operations between banks, nor for other reasons that delay the transfer of money into the account.

 

For email or phone orders, you can choose any of the following payment methods. The conditions for each of these options are listed above:

For reasons beyond the control of SUNTIME EVENTS SRL, there may sometimes be errors in bank transactions thatdelay the registration and processing of the order by us. In case of a message from the bank or if you notice that the transaction on your account has not been carried out, please notify us in writing at comenzi@purpleflowers.ro.

 

Any problems that may occur in banking transactions may delay the fulfilment of the order and, although we regret anydelay, and will do our best to limit the unpleasant effects of such incidents, we have no control over these situations, cannot be held responsible for them and will not refund the payment if the order has been placed even late.

 

Product prices can only be negotiated in the case of large volumes. 12 BILLING

The prices and payment method chosen are specified in the order confirmation received by email. Any order placed onwww.purpleflowers.ro will be processed and processed only after confirmation of payment. The invoice will be issued in the name of the payer (natural or legal person), who is obliged to provide us with all the necessary information to draw up the invoice in accordance with the laws in force.

 

According to Article 155, para. 6 of the Fiscal Code “Signing and stamping of invoices are not mandatory”, and according to the Fiscal Code art.155, paragraph 8, point c: “Invoices may be sent by electronic means”. SUNTIME EVENTS SRL is not obliged to provide the customer with the invoice in physical format, but only in electronic format. At the client’s request, however, we can send the invoice in physical format, signed and stamped, by courier with payment to the recipient. Receipt / tax receipt are issued only for cash payments.

 

13   WARRANTIES AND REFUND PAYMENTS

 

For products sold on www.purpleflowers.ro, we offer the guarantee of 100% refund of the payment, the offer of a gift voucher in countervalue or the delivery of the product to the address/to another address/to another date without any cost,if the delivery was not made for reasons that were strictly related to SUNTIME EVENTS SRL or if the experience of purchasing our products produced a real and justified dissatisfaction of the customer. In the case of any of the situations listed above, the only options for compensation are a refund of the amount paid, agift voucher in exchange for future purchases or re-delivery of the product to another address/at another address/at another time. 14  COMPLAINTS, PENALTIES AND PAYMENT DEADLINE

A complaint may be submitted within 24 hours of the occurrence of the event complained of for perishable products and within 14 days of delivery for non-perishableproducts. The deadline for resolving complaints is 5 days.

 

15  PERSONAL DATA

 

SUNTIME EVENTS SRL processes the personal data of customers / visitors, by automated and manual means,intended for the issuance of invoices for services and products, delivery of orders placed, collection of claims related to them and the resolution of requests in connection with the activity carried out by the company.

 

We consider ensuring the right to personal data protection as a fundamental commitment of SUNTIME EVENTS SRL (Purple Flowers), therefore we dedicate all our resources and efforts to process your data in full compliance with Regulation (EU) 2016/679 (“General Data Protection Regulation” or “GDPR”).

 

 

According to the decision no. 200/14.12.2015, of the National Authority for the Supervision of Personal Data Processing (ANSPDCP), data processing carried out by companies for the above-mentioned purposes does not require registration with ANSPDCP as a personal data controller.

Name, address, telephone number, email address are collected and processed in order to issue payment documents and to carry out the bank transaction (if applicable), in order to contact the customer (if necessary), and inorder to deliver the ordered product to the indicated address. The provision of these data is mandatory in order to honour the order placed on www.purpleflowers.ro. Refusal to provide these data, determines the cancellation of the order placed on the site and the refund of the payment made (if applicable). The registered information is intended for use by SUNTIME EVENTS SRL and is communicated only to the courier company in order to deliver the product to the indicated address.

 

According to Law no. 677/2001, customers/visitors benefit from the right of access, the right to intervene on data, the right not to be subject to an individual decision and the right to appeal to justice. SUNTIME EVENTS SRL shall be liable to the client for all contractual obligations, even in the case of assignment and/or subcontracting.

 

19  PRIVACY AND PUBLICITY

 

The client understands the intellectual property rights and will not disclose to any third party or make public any of the information received from SUNTIME EVENTS SRL. All plans,

 

documents and information of any nature provided by the client, including but not limited to the order, will remain theproperty of the company. They may only be used for the fulfilment of the order.

 

No public statement, promotion, press release or any other disclosure to third parties will be made by the customerregarding the order, delivery, communications, problems occurred or proposed solutions, without the prior written consent of SUNTIME EVENTS SRL. Any defamation, negative publicity / advertising, damaging public information, made by the customer without our consent, attract appeal to the competent courts and claim for payment of damages, depending on the damage created.

 

20  LIABILITY

 

SUNTIME EVENTS SRL shall not be liable for damages of any kind that customers or any third parties may suffer as a result of SUNTIME EVENTS SRL’s performance of any of its obligations under the order and for damages resultingfrom the use of the goods and services after delivery and in particular for loss of or damage to the products.

 

If SUNTIME EVENTS SRL does not perform its obligations, the client will send a written notice to the company, byemail, to hello@purpleflowers.ro. SUNTIME EVENTS SRL will propose an action plan to be validated between the parties within 5 working days of the notification.

 

21  MAJOR FORCE

 

Neither party shall be liable for non-performance of its contractual obligations if such non- performance is due to an event of force majeure. Force majeure is an unforeseeable event beyond the control of the parties and which cannot be avoided.

 

22  COMPLIANCE WITH LAWS AND STANDARDS

 

According to the Romanian legislation in force, this form entitled Terms and Conditions represents a sale-purchase contract, and the acceptance of this form means the remote signature of the sale-purchase contract.

 

The company complies with all laws, regulations and ordinances applicable to its contractual performance, regarding the manufacture, assembly, handling, transportation, storage, packaging or delivery of goods and services and applicable to health, safety, environment.

 

This contract is subject to Romanian law. Any disputes arising out of the interpretation and execution of this contract shall be settled amicably, and in the event of failure to reach an agreement in this way, the competent courts shall have jurisdiction.

 

This Terms and Conditions form is written in Romanian, in accordance with the current laws in force in Romania. Any translation into other languages is based on the Romanian version, and any dispute will be settled on the basis of the Romanian version of the Terms and Conditions.

 

23  MISCELLANEOUS PROVISIONS

 

In the event that one or more of the provisions of the Terms and Conditions form is held to be invalid, void or unenforceable, the remaining provisions shall remain in full force and effect. The parties will endeavour to agree together on new provisions that respect the spirit of the original provisions.

SUNTIME EVENTS SRL and the clients shall be deemed independent contractors and neither party is granted theright or authority to assume or create any obligation on behalf of or to the detriment of the other.

The terms and conditions of www.purpleflowers.ro, supersede any prior written or oral agreements between the partiesrelating to the subject matter of this Agreement and may not be modified or changed except by written agreement signed by both parties.

24  CONSENT

Customers/visitors of this website agree to this set of terms and conditions from the moment they enter the website until the end of their visit here, regardless of whether they order products from this website or not.
